"e-Statement – Customer Declaration"

Applicable to both Deposit Accounts and Credit Card Accounts
  1. I authorise Industrial and Commercial Bank of China (Asia) Limited (the "Bank") to provide my account statements in electronic format in connection with each of my accounts (as from time to time prescribed by the Bank), communicated through electronic services to an internet website operated and/or maintained by the Bank for my access and use with a reminder email to be sent to my registered email address (each and collectively known as the "e-Statement Service").
  2. I agree to comply with any and all laws, regulations applicable to the e-Statement Service, now existing or which may be hereinafter be enacted, issued or enforced together with such other relevant applicable terms and conditions that the Bank from time to time imposed in connection with the provision of the e-Statement Service.
  3. I agree to assume the risks associated with usage of the e-Statement Service summarily set out as follows:-
    1. appropriate computer equipment and software, internet access, a specific internet banking account and designated email address are required for using the e-Statement Service;
    2. communication through internet and email may be subject to certain information technology risks, including (i) leakage of data (including but not limited to personal data), loss of data, incorrect data transmission, bugs and virus attack due to the public nature of internet; and (ii) unauthorized use, system failure, unavailability of services, interception, interruption, transmission blackout or delayed transmission;
    3. additional cost will be incurred for using the e-Statement Service including services charge by internet service provider, appropriate telecommunications equipment, computer and software capable of receiving the e-statement and email; and
    4. email will be the only notice that the e-statement has been posted on the Bank's website. I undertake to check the designated email address and Bank's website regularly to ensure there is no delay in receiving the e-statement.
  4. I agree that, subject to any applicable laws and regulations, unless caused by the Bank's negligence or wilful default, the Bank shall not be liable for any loss, damage or expense suffered by me in connection with e-Statement Service.
  5. I acknowledge and agree that:
    1. the e-statement shall be regarded as effectively communicated upon the Bank's dispatch of the same on the relevant website. I agree to promptly review the e-statement via Personal Internet Banking Services upon receiving the email notice;
    2. it is my duty to examine the e-statement and download the same before they are deleted by the Bank from the website. I understand that I shall be required to pay the Bank a reasonable service charge as it may determine from time to time in order to obtain a hard copy of the relevant statement that is no longer available for access through the website;
    3. the e-Statement Service shall replace the provision of hard copy of the statement. The Bank shall not provide any physical copies of the relevant statement to me. In the event that physical copy of the statement is requested by me, I shall pay the Bank a reasonable service charge as it may determine from time to time; and
    4. I undertake to provide the Bank with my updated and correct email address that has sufficient capacity at all times in order to use the e-Statement Service.
Applicable to Deposit Accounts only
  1. I acknowledge and agree that:
    1. the records for my account e-statements will be communicated through the Bank's electronic services and kept by the Bank on the relevant webpage for my access or use through the Personal Internet Banking Services. The e-statements will be retained for a reasonable period as determined by the Bank from time to time. Thereafter, the e-statements will be deleted from the website (Remark: monthly e-statement will be retained for 12 months, daily e-statement will be retained for 1 month only); and
    2. if I decide to terminate the e-Statement Service, I have to provide sufficient and reasonable notice, which shall be at least 3 working days before the next statement date, to the Bank.
  2. I agree to examine the statement through my Personal Internet Banking Services and notify the Bank within 90 days after the communication is made for any error or unauthorised transaction. In the absence of my notification within that period, all entries in the statement will become conclusive and binding on me, except for manifest error.
Applicable to Credit Card Accounts only
  1. I acknowledge and agree that:
    1. the records for my credit card account statement will be communicated through the Bank's electronic services and kept by the Bank on the relevant webpage for my access or use through the Personal Internet Banking Services. The e-statements will be kept with a maximum of 12 months or a reasonable period as determined by the Bank from time to time. Thereafter, the e-statements will be deleted from the website; and
    2. If I decide to terminate the e-Statement Service, I have to provide sufficient and reasonable notice, which shall be at least 7 working days before the next statement date, to the Bank.
  2. I agree to examine the statement through my Personal Internet Banking Services and notify the Bank within 60 days after the communication is made for any error or unauthorized transaction. In the absence of my notification within that period, all entries in the statement will become conclusive and binding on me, except for manifest error.
